The Solution


Below are eight recommendations that will help jurisdictions move from resource-based to risk-based bail decision-making process. These recommendations are designed to allow for more informed decision-making at each phase in the pretrial process, from first contact with law enforcement through adjudication. These recommendations require the support of all those involved in the criminal justice system.

  What has been demonstrated here is that usually only one factor determines whether a defendant stays in jail before he comes to trial. That factor is not guilt or innocence. It is not the nature of the crime. It is not the character of the defendant. That factor is, simply, money.
