Technical Assistance
I would like to start a Pretrial Drug Court or Pretrial Drug Diversion Program in my district.  I work in the federal system and there is only one known pretrial diversion program in our system.

I've talked to my Chief and the Chief Magistrate Judge regarding the need for such a program.  Although they both agree that it would be a good idea, no one seems to know where to begin.  Any suggestions?

I recently attended NAPSA in Milwaukee.  I believe it was at the Tuesday Plenary Session when the honorable judge noted that the "presumption of innocence" was simply an "evidentiary" principle.  Could you clarify this?  I'm not sure what he means by this. I'm guessing that it might relate to the idea that when "proof is evident or the presumption great that the defendant is guilty of the offense" then the presumption of innocence principle loses some, if not all, of it's relevance when making a bond recommendation and decision.

I am a Probation Operations Management Specialist with the Administrative Office of the Illinois Courts.  One of my local jurisdictions has been asked by the Chief Judge to implement a Pretrial Diversion program.  I have been asked to compile information regarding the standards, policies, procedures, as well as any other pertinent information that may help this jurisdiction.  I have seen several valuable resources on the PJI web site, but was wondering if there was anything in addition you may recommend, or if you would have any recommendation on where to start.  In addition, I would like to provide any description of technical assistance as well as a contact name and number to the local so if they would like to seek assistance they have a contact person.  Thank you in advance for any information and/or guidance you can provide.  It is most appreciated.

This is Xia Wang, an assistant professor at ASU.  I am working on a paper using the SCPS data.  I am wondering whether I could ask you a question related to the data: the ADJ1 variable (adjudication outcome) has 4 valid values--"convicted," "not convicted," "other outcome," and "case pending."  What is "other outcome?"  Could I treat "other outcome: and "case pending" as "not convicted?"  Thank you very much for your expertise!

A lady called me today with a question about the costs of a pretrial
drug testing unit.  She is doing a Grad paper & was researching things
on our website and wanted to know about the costs associated with
starting up & running a drug testing unit for a year.  As part of her
project she has to make a financial plan for a year and wanted to ask
about associated costs.  I imagine there are some numbers somewhere or
that it could be figured out based on estimating costs of equipment,

I'm interested in knowing what policies other pretrial services agencies have in terms of preparing a pretrial services report for defendants who have a  sex offense conviction.  For example, do other pretrial agencies review the sex offender registry to ascertain whether a defendant is registered? If the defendant is not registered, what further action is taken, e.g., recommending a condition to register, reporting the fact that the defendant is not registered in the pretrial services report, etc.  Thank you.

The practice here in Horry County, SC, is that bail bondsmen will not put up bail for minor offenses with bonds in the $500 range.  The defendant either comes up with the full amount, or stays in custody.  Is this a common practice in the US?  Do you have a survey of practices in the various states?

To Whom It May Concern:

I have a question. I work for Pretrial Services for the local county government in Colorado. As part of our supervised release program, the Judge often order electronic monitoring or in-home alcohol monitoring services. Fees go along with the services and require the defendant to pay them. Our department has acquired debt of unpaid supervision fees. We do not have a collections department. My question to you is do you know of any other methods we can use to collect the fees other then requesting restitution (that doesn’t always happen)? Are we better off looking into a collection agency?

NAPSA Email: My name is Sara Carpenter, and I am the Court Services Administrator at Wisconsin Community Services in Milwaukee, Wisconsin.  I am interested in presenting at the Annual NAPSA Conference, specifically co-presenting with Mike Napolilli from Alcohol Monitoring Systems, on SCRAM and our Pretrial Intoxicated Driver Intervention Programs at WCS.  I have some questions about the ability to present and the conference in general, so if someone would please call me at 262)993-2581, I would appreciate it.  Mike and I recently co-presented at the Wisconsin Association of Treatment Court Professionals' Conference, and I presented in 2008 at the NAPSA Conference, on a panel of presenters.

NAPSA EMAIL Hello.  My name is Mary Walsh-Navarro and I am a division manager at Coconino County Pretrial Services in Flagstaff, Arizona.  Our department is exploring the possibility of implementing a fee for release on Pretrial Services.  We are trying to find out what other departments charge, how much, where the authority to charge came from (internally, from the County board, presiding judge, etc.) and what type of success they have collecting.  I spoke with Jeff Kilpatrick from Alachua County, Florida and he gave me your email address to see if NAPSA had any information regarding this topic.

Hello, I came across your site while doign research for an article about veterans treatment courts for a military newspaper, the Stars and Stripes. How are these courts set up? Do they need state bar association approval? Who determines which locales get these specialty courts? Also, have there been any complaints that these courts are unconstitutional because providing veterans with separate courts violates the "equal protection under the law" in the 14th amendment? Thanks, I am trying to finish this article by the end of the week.

In Hawaii County (Big Island), the Dept of Health piloted a post-booking mental health jail diversion program which has been running for the past 6 years or so.  As you might expect, funding for community-based mental health case-managers has been dramatically cut, and consequently services to this population have been cut as well.  From a pretrial perspective, I expect that these same defendants will end up on our front porch repeatedly, without the MH services they require.  Im curious to know how other jurisdictions are dealing with these funding issues and am looking for creative ways to sustain the program.  Any fundinig sources available that PJI might know about?  Any information you can provide would be appreciated.
